Introduction

The new European regulation that came into force in 2018 concerns the protection of natural persons with regard to the processing of personal data carried out by legal or natural persons: the GDPR.

As part of its activities and in accordance with applicable legislation, Piter undertakes to ensure the protection, confidentiality and security of your Personal data, and to respect your privacy.

This document describes the measures that Piter undertakes to implement in order to meet data protection requirements. In particular, Piter defines the organisation that will be put in place, the methodology to be followed to manage the security of the project, and the technical, organisational and procedural measures that will be implemented.

1. Definitions

Personal data, Personal Data, or Data

any information relating to an identified or identifiable natural person. An "identifiable natural person" is deemed to be a natural person who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier, or to one or more factors specific to their physical, physiological, genetic, mental, economic, cultural or social identity.

Processing

any operation or set of operations performed on personal data or sets of personal data, whether or not by automated means, such as collection, recording, organisation, storage, alteration, retrieval or consultation.

Cookies

refers to a text file that may be stored — subject to your consent expressed in accordance with the applicable French and European regulations (art. 5. 3 of the ePrivacy Directive 2008/58/EC as amended by Directive 2009/136/EC, or any subsequent text arising from it) — in a space dedicated to your browsing software on your device's hard drive, when you visit one of Our services or an electronic communication service of one of Our partners, or when you install software or a mobile application. A Cookie allows its sender to identify the device in which it is stored, for the period of validity or storage of the Cookie.

Consent

any freely given, specific, informed and unambiguous indication of the data subject's wishes by which they signify, by a statement or by a clear affirmative action, agreement to the processing of personal data relating to them.

Data controller

the natural or legal person, department or other body which, alone or jointly with others, determines the purposes and means of the processing. In this case, this is Piter.

GDPR

General Data Protection Regulation, i.e. European Regulation 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data.

Piter

a French SAS with a share capital of 100,000 Euros, registered with the Rennes Trade and Companies Register under SIRET number 918 767 625 00018, whose registered office is located at Bureau 3, 5 allée de la Grande Treille, 35200 Rennes. Piter offers a platform for clients that allows them to manage professional services and connect with digital services companies, engineering firms, consultancies and freelancers, with the aim of delivering projects that require a certain level of expertise. (hereinafter also referred to as "We" or the "Company")

Website or Site

refers to this website, owned and administered by Piter, together with all of its features, with the domain name: www.piter.at.

Visitor

any person connecting to our website www.piter.at, whatever use they make of it (hereinafter also referred to as "You" or "Your")

Employee

any person employed by the entity creating a User account.

2. Visitor data

2.1 Data provided by the Visitor

When you use our Website, we may ask you to provide us with certain Personal Data that can be used to contact or identify you. This data is as follows:

• Contact form: you may contact us at any time via Our contact form. In order to handle your request, we need to collect the following Personal Data: last name, first name, email, phone, company and job title.
• Download: when you wish to download a document, we ask you for the following Personal Data: last name, first name, email, phone, company.
• Newsletter: if you wish to subscribe and receive our content, we ask you to provide the following Personal Data: last name, first name, email, phone, company.
• Job application: if you wish to apply for one of our job offers or to submit a spontaneous application, we will collect the following Personal Data: last name, first name, email, phone, as well as any Personal Data that may appear in your Curriculum Vitae.

2.2 Data generated by the Visitor

We may also collect Usage Data, in particular:

• the IP address of the device connected to the Internet,
• the date and time a device connects to an electronic communication service,
• the URL (internet address) of the web page accessed by the device visiting an electronic communication service,
• the operating system and the version of the browsing software used by the device,
• the type of operating system used by the device,
• the identifier and content of a Cookie file stored by Us on the device,
• the language of the browsing software used by the device,
• the geographic area in which your device is located.

3. Purposes and uses of the Data

• To provide and maintain our Site, including to monitor the use of our Site.
• To secure our Site: certain browsing data must be retained by law to enable Us to ensure the security of Our site and to detect, prevent or track malicious intrusion attempts or breaches of the terms of use of Our Site. This applies to the IP address and to the dates and times a device connects to Our Site.
• To contact you: to contact you through the communication channels and using the contact details you provided to us.
• To send you special offers and general information about other goods, services and events that we offer and that are similar to those you have already purchased or enquired about, unless you have indicated that you do not wish to receive such information.

• To review your job applications: to make sure that your profile and skills match our internal needs or the job offer we published.

4. Data recipients

Personal data may be accessed and processed by authorised Piter personnel. A system for tracing their actions is in place in order to guarantee the protection of this data.

It is important to point out that Piter does not sell or rent your Personal Data to third parties for commercial purposes.

Following a subpoena, court decision, warrant or order, or any other regulation, Piter may have to disclose personal data and other related information where necessary. Piter may also choose to exercise its rights in court against any type of action.

5. Data transfers

When you use our Site, Piter neither collects nor processes Personal data for commercial purposes.

The information that may be passed on to third parties consists exclusively of professional data, necessary for the provision, adaptation or proposal of certain options or services, at each client's discretion and according to their needs.

The third parties that may have access to this data are identified by name in the contracts entered into with our clients. Any transfers are therefore limited to those partners and service providers necessary for the implementation of the services or options offered.

The professional data thus communicated is neither sold, nor rented, nor used for prospecting or commercial advertising purposes, and is not subject to independent commercial exploitation by Piter or by the third parties concerned.

Piter ensures that the data transmitted is limited to what is strictly necessary for the purpose for which it is communicated, and that the third parties concerned implement appropriate measures to ensure its confidentiality and security.

Apart from the cases expressly provided for in the contracts or required by applicable law, Piter will not pass this data on to other third parties without the prior agreement of the client concerned.

Finally, certain information may be disclosed to the competent administrative or judicial authorities where such disclosure is required by applicable law or regulation, or where it is necessary to protect and defend Piter's legitimate rights and interests.

6. Retention periods

Piter only retains the Data for as long as necessary to fulfil the purposes mentioned above, unless you have exercised your right to delete the aforementioned data before the end of that period. We will retain and use your Personal Data to the extent necessary to comply with our legal obligations, to resolve disputes and to enforce our agreements and policies.

We undertake to archive or delete your Personal Data as soon as it is no longer necessary for the purpose for which it was collected and processed.

7. Data security

Piter cares about the protection of personal data and undertakes to ensure the best level of personal data protection in accordance with legal obligations and the GDPR.

Piter has therefore defined technical and organisational measures making it possible to protect data appropriately according to its nature, the scope of the processing and its accessibility. These may include, for example, data anonymisation, access rights management, secure data flows, and so on.

All Piter staff are made aware of data protection. Our IT teams are trained in data protection and are therefore able to react quickly in the event of a possible personal data breach.

In addition, all of your data is hosted in France in a dedicated environment on OVH data centres, a hosting provider holding ISO 27001 certification.

8. Exercising your rights regarding Personal Data

8.1 How to exercise your rights

You have rights concerning your Personal Data and the processing carried out by Piter. You may therefore request at any time access to the personal data concerning you, its rectification, its erasure (insofar as this does not prevent the proper performance of the contract or compliance with Piter's legal obligations) and object to one or more specific data processing operations under the conditions provided for by the regulations.

You have the option of lodging a complaint with the supervisory authority responsible for compliance with personal data obligations.

You can exercise these rights by writing to the following email address: personal-data@piter.at. Your request will be processed within one (1) month of its receipt by our data protection team. In the event of doubt as to the identity of the Visitor, Piter reserves the right to request proof of identity.

It is important that the information provided to Piter is accurate and up to date.

8.2 Data Protection Officer

The appointment of a Data Protection Officer is "mandatory in public sector bodies, in companies that carry out regular and systematic monitoring of individuals on a large scale, or that process sensitive data on a large scale."

Piter neither holds nor processes any sensitive data (within the meaning of the GDPR/CNIL).

9. Cookie management
